Inmate carries the burden of proof in this case and that burden is "extraordinarily" high. Gordie didn't come close to meeting that burden at the hearing and his two post-hearing memos were an absolute mess. As the Government pointed out in their sur-reply, Gordie had over 6 years to put forth "new" evidence that demonstrated inmate's "actual innocence," yet all Gordie did was regurgitate the same debunked claims leveled by the MacDonald camp for the past 43 years.
Taking shots at inmate's brother and the dedicated men/women who brought forth justice for Colette/Kimmie/Kristen demonstrates that you can't buy or manufacture class. You either have it or you don't. Let's talk turkey, your recent posts are the same tired song and dance. You make vague references, useless predictions, and dubious claims without a shred of evidence to back up any of your hollow chatter. I have no idea what the "fist of 2014," means, but it would be very surprising if Judge Fox made a decision by the New Year. On average, he has taken 2 years to make decisions in this case, so I would assume he will take his sweet time before putting the final nail in MacDonald's legal coffin.
In the future, I would advocate for at least a little meat in your posts. Anybody can make claims. It's a whole different animal when you have to provide concrete data to back your claims. You can continue to fool yourself into thinking that Judge Fox and the MacDonald camp are on the same cognitive path, but you should ask yourself whether Gordie provided any PROOF of inmate's innocence? The transcripts of the hearing certainly don't show that Gordie provided that proof and his post-hearing memos added nothing to the fantasy narrative.

By the way, what do you make of Errol Morris' admission that he doesn't believe that Judge Fox will grant inmate relief? Was that admission deflating to the MacDonald camp? How did Rebel conclude that Judge Fox will rule in MacDonald's favor? Simple, she made it up. There is no historical evidence that would lead anyone to believe that Judge Fox would grant inmate relief nor would he tip his hand to only one side of the legal equation. To claim that Judge Fox would tell Gordie that he was going to set his client free and NOT say a word to Brian Murtagh about his thought process is engaging in fantasy. http://www.macdonaldcasefacts.com

Thank you, JTF. I appreciate your response and the facts you outlined.
I know why I believed in MacDonald's innocence for a short while but I am still amazed that he manages to get hardcore supporters, what with the DNA evidence, the ultimate failure of FJ and the inconsistencies between MacDonald's "injuries" and those suffered by Colette and the children. There has never been any debate as to how brutally his family was attacked and killed and even if you want to believe MacDonald's revised and exacerbated injuries, they still are nowhere close to the viciousness and rage inflicted upon Colette and the girls. There is a medical record clearly showing the injuries on MacDonald's body when he was admitted to Womack on February 17. Do these believers think the doctors at Womack and Womack Hospital itself are in on some conspiracy to frame MacDonald? Why would they be? I just don't understand it.
